Florida Pool Barrier Law (Chapter 515) in 2026: Barrier and Safety Feature Rules for Sarasota and Manatee Pool Homes

Chapter 515, Florida Statutes, the "Preston de Ibern/McKenzie Merriam Residential Swimming Pool Safety Act," was enacted by chapter 2000-143, Laws of Florida, and s. 515.27 was last amended by chapter 2016-129 (s. 515.27 history). The building code section below is the 8th Edition (2023) Florida Building Code, which Sarasota County applies to building applications from December 31, 2023 (Sarasota County Building).

Checked against the official sources on October 1, 2026.

Not legal advice. Your building department decides whether a pool passes final inspection.

Who Chapter 515 applies to

The Legislature's stated intent is "that all new residential swimming pools, spas, and hot tubs be equipped with at least one pool safety feature" (s. 515.23).

Definitions in s. 515.25:

  • "Swimming pool" means a structure in a residential area "intended for swimming or recreational bathing" that "contains water over 24 inches deep," including in-ground, aboveground and on-ground pools, hot tubs and nonportable spas.
  • "Residential" means "situated on the premises of a detached one-family or two-family dwelling or a one-family townhouse not more than three stories high."
  • "Young child" means "any person under the age of 6 years."

The chapter does not apply to public pools, "kiddie pools," a portable spa with a safety cover that complies with ASTM F1346-91, or a city or county that has adopted a pool safety ordinance "equal to or more stringent" than the chapter (s. 515.37).

The Florida Department of Health states that "In Florida, drowning is the leading cause of unintentional death to children ages 1-4" (FDOH Drowning Prevention).

The five safety feature options in s. 515.27

"In order to pass final inspection and receive a certificate of completion, a residential swimming pool must meet at least one of the following requirements" (s. 515.27(1)):

  1. A barrier enclosure that meets s. 515.29.
  2. An "approved safety pool cover," defined as a cover meeting ASTM standard F1346-91 (s. 515.25(1)).
  3. Exit alarms on "All doors and windows providing direct access from the home to the pool," with "a minimum sound pressure rating of 85 dB A at 10 feet."
  4. On "All doors providing direct access from the home to the pool," a "self-closing, self-latching device with a release mechanism placed no lower than 54 inches above the floor."
  5. A pool alarm that sounds "upon detection of an accidental or unauthorized entrance into the water," independently certified to ASTM F2208. A wearable alarm attached to a child does not count.

A person who fails to equip a new residential pool with at least one feature "commits a misdemeanor of the second degree." No penalty is imposed if, within 45 days, the pool is equipped and the person attends a drowning prevention education program (s. 515.27(2)).

Barrier rules in s. 515.29

From s. 515.29:

  • "The barrier must be at least 4 feet high on the outside."
  • It "may not have any gaps, openings, indentations, protrusions, or structural components that could allow a young child to crawl under, squeeze through, or climb over the barrier."
  • It must be "placed sufficiently away from the water's edge" so a child who gets through cannot fall straight into the water.
  • Gates "must open outward away from the pool and be self-closing and equipped with a self-latching locking device," with the release "on the pool side of the gate."
  • "A wall of a dwelling may serve as part of the barrier if it does not contain any door or window that opens to provide access to the swimming pool."
  • The barrier may not sit where a permanent structure or equipment can be used to climb it.

Measurements in Florida Building Code R4501.17

The Florida Building Code, Residential, chapter 45, section R4501.17, adds measurements. An approved safety cover complying with ASTM F1346 is an exception to the barrier section.

  • Height: at least 48 inches above grade, measured on the side facing away from the pool.
  • Gap at the bottom: no more than 2 inches between grade and the barrier.
  • Openings: must not allow passage of a 4-inch-diameter sphere.
  • Vertical members with horizontals less than 45 inches apart: spacing no more than 1-3/4 inches, horizontals on the pool side.
  • Vertical members with horizontals 45 inches or more apart: spacing no more than 4 inches.
  • Chain link: mesh no larger than 2-1/4 inches square, unless slats reduce openings to 1-3/4 inches.
  • Removable child barrier: at least 20 inches from the water's edge, one end not removable without tools.

Gate rules in R4501.17.1.8:

  • Access gates "shall be self-closing" with a "self-latching locking device located on the pool side of the gate."
  • If the release sits no less than 54 inches from the bottom of the gate, it may be on either side of the gate.
  • "Gates that provide access to the swimming pool must open outward away from the pool."
  • No opening greater than 1/2 inch within 18 inches of the release mechanism.

Screen enclosure and house wall rules

From R4501.17:

  • "Standard screen enclosures which meet the requirements of Section R4501.17 may be utilized as part of or all of the 'barrier' and shall be considered a 'nondwelling' wall."
  • Where the house wall is part of the barrier, one of three options applies: exit alarms complying with UL 2017 at 85 dBA at 10 feet, with any deactivation switch at least 54 inches above the threshold; self-closing, self-latching devices on the doors at least 54 inches above the threshold; or a pool alarm certified to ASTM F2208.
  • A mesh safety barrier must comply with ASTM F2286, and "Mesh fences shall not be installed on top of above-ground/on-ground private swimming pools."

Pool and fence permits in Sarasota and Manatee

Manatee County:

  • Swimming pools, including above ground pools taller than 24 inches, require a state certified or locally licensed contractor and a building permit (Manatee County permit list).
  • A pool/spa permit application requires a "Pool Safety Act Form" (Manatee County Permitting).
  • "Non-Structural residential fences, such as wood, chain link and vinyl are exempt from obtaining a building permit when located on a one or two-family lot that is not located in a flood hazard area" (Manatee County permit list).

HB 803 permit exemption (s. 553.79(1)(g), effective July 1, 2026):

Who builds and services pools

A licensed pool contractor who agrees to build a residential pool must give the buyer "a document containing the requirements of this chapter" and the Department of Health drowning prevention publication (s. 515.33).

DBPR lists "Repair or replace swimming pool pumps for compensation" as work that needs a DBPR license, and "Clean swimming pools" as work that does not (DBPR). Check any pool or fence contractor on the DBPR license search.

Gate and barrier checks for an existing pool

Items to check against R4501.17 and s. 515.29:

  • The gate swings outward, away from the pool.
  • The gate closes and latches by itself from any open position.
  • The latch release sits on the pool side, or at least 54 inches up.
  • No permanent structure or equipment, such as an AC unit, placed where a child can use it to climb the barrier.
  • House doors to the pool area have a working alarm or a self-closing, self-latching device at 54 inches or higher.
